Terms of Service

SohamProp provides tools for real-estate agents, agencies, and landlords ("Customers") to publish property listings, capture buyer enquiries ("Leads"), and manage their public storefront. Listing buyers and property hunters use the Service to discover and contact Customers.

You may create a workspace via the signup flow. You are responsible for maintaining the confidentiality of your authentication credentials and for any activity under your workspace. We use Firebase Authentication to verify identity and may suspend or terminate workspaces engaged in fraud, abuse, or violation of these Terms.

You retain ownership of property listings, photos, descriptions, branding assets, and other content you upload to your workspace ("Customer Content"). You grant SohamProp a worldwide, non-exclusive, royalty-free license to host, copy, transmit, display, and process Customer Content solely for the purpose of operating the Service for you.

You represent and warrant that your Customer Content:

• does not infringe any third-party rights (copyright, trademark, privacy);
• is accurate and not misleading about the property, price, or availability;
• complies with applicable laws including consumer-protection and real-estate regulations;
• does not contain malware, illegal content, or material that incites harm.

You agree not to: (a) attempt to gain unauthorised access to other workspaces or to SohamProp infrastructure; (b) use the Service for spam, phishing, or other deceptive practices; (c) reverse engineer, decompile, or otherwise attempt to extract source code; (d) resell access to the Service without our written consent; (e) use automated scraping at a rate that materially degrades the Service for others.

The Service is offered on free and paid plans. Paid plans are billed in advance on a monthly or annual basis through our payment processor. Fees are inclusive of applicable GST unless otherwise stated. Refund and cancellation terms are described in our Refund Policy.

We aim to keep the Service available but do not guarantee uninterrupted uptime. Scheduled maintenance, third-party outages (cloud provider, payment gateway, email delivery), and force majeure events may cause temporary unavailability. We are not liable for losses arising from such interruptions.

You may close your workspace at any time. We may suspend or terminate your access for material breach of these Terms, fraud, non-payment, or as required by law. Upon termination, your Customer Content may be deleted after a 30-day grace period.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, except as required by law. SohamProp does not act as a real-estate broker or escrow agent. Transactions, viewings, and money transfers between Customers and listing buyers happen off-platform and are entirely between those parties.

To the maximum extent permitted by applicable law, SohamProp's total aggregate liability for any claim arising out of or relating to the Service will not exceed the fees paid by you in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages, including lost profits or data.

These Terms are governed by the laws of India. Disputes will be subject to the exclusive jurisdiction of the courts located in the city where SohamProp is registered.

We may update these Terms from time to time. Material changes will be notified via email or an in-app banner at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
